Competition Law

A free market is not a jungle. Your right to compete fairly is a value that deserves to be defended with determination.

Competition is the driving force of the economy, but only when it is conducted fairly and transparently. All too often, small and medium-sized enterprises (SMEs) find themselves suffering from the unfair conduct of their competitors or being overpowered by their stronger economic partners in contractual agreements, which causes serious damage to their business.

We support companies that have fallen victim to such practices. Our goal is not just to intervene, but to restore balance and ensure that you can compete on a level playing field.

What we do

Our assistance focuses on two crucial areas for the health of an SME: defence against unfair competition and protection against contractual abuses.

Defence against unfair competition: We combat unfair competition in all its forms. We intervene when your reputation is threatened by smear campaigns or false reviews, when your products are slavishly imitated to exploit your investments or when a competitor tries to steal your key employees and trade secrets.

Protection from abuse of contractual power: a larger partner is not a master. We defend you against abuse by stronger companies. If you find yourself subject to unfair or discriminatory contractual conditions, you are not obliged to accept them. The law expressly prohibits both the abuse of a dominant position (antitrust legislation) and the abuse of economic dependence. We enforce these principles to ensure that your agreements are fair and that your commercial freedom is respected.

We also protect you from anti-competitive cartels. An SME can be the victim not only of a single company, but also of a group of companies acting together in an anti-competitive manner. Sometimes, supply prices increase for no apparent reason, or distribution channels close inexplicably. These anomalies may be the result of an anti-competitive cartel — an illegal agreement between companies acting as a single entity to control the market to your disadvantage. We expose these agreements and protect you, whether it is suppliers agreeing to increase prices or distributors imposing unfair conditions to hinder your sales. We intervene to stop these practices and ensure you receive fair compensation.
